Virginia: If it's wrong to exclude Gingrich and Perry, can they get on ballot?

Newt Gingrich is not amused at being left off the Virginia primary ballot, Rick Perry is suing, and some in the state are sympathetic. So what went wrong? ?And can it be undone??

?You?ve got to get it organized,? Mr. Romney chided Tuesday in New Hampshire.

But to Mr. Gingrich, the former House speaker and a leading contender for the Republican presidential nomination, the ballot failure is no laughing matter.

He also has influential Virginians who agree that it was wrong to exclude Gingrich and Texas Gov. Rick Perry from the March 6 Virginia primary. Each had submitted more than the required 10,000 signatures, but on Dec. 24, state election officials deemed that they did not have enough valid signatures to qualify.

Romney and Texas Rep. Ron Paul are the only two candidates to qualify for the Virginia primary ballot. Other major contenders, such as Rep. Michele Bachmann of Minnesota and former Sen. Rick Santorum of Pennsylvania, did not attempt to collect the necessary signatures.

On Wednesday, two former state party chairmen ? a Republican and a Democrat ??held a press conference in Richmond to call for emergency legislation that would establish a new standard for participation in a presidential primary.

The majority leader of the Virginia House of Delegates, Kirk Cox (R), has stated that there?s not enough time to pass legislation. But Bill Pascoe, executive vice president of the conservative group Citizens for the Republic, disagrees.

?Once the legislative and executive branch leaders realize how screwed up the system is, I think a relatively simple legislative fix will present itself to them, and they?ll be able to move a bill on the first day of the legislature, on Jan. 11,? says Mr. Pascoe in an interview.

?They could say if the FEC [Federal Election Commission] qualifies you for matching funds, you qualify for the Virginia ballot,? Pascoe suggests.

Pascoe is working with the two former Virginia party chairs ? Democrat Paul Goldman and Republican Pat McSweeney ? in urging the state legislature to act. He says they?re not backing a particular candidate, rather working on behalf of the right of Virginians to cast a ballot for the candidate of their choice.

Gingrich, meanwhile, is now blaming not only the system, but fraud as well for his exclusion from the Virginia ballot.

Miscarriage of justice points to fingerprint flaws

FINGERPRINTS were once the cornerstone of forensic identification. Now a report into a miscarriage of justice has renewed pressure on print examiners to improve their methods, while two new studies reveal the extent of their fallibility. The results could change the fingerprint profession worldwide.

The Fingerprint Inquiry was launched by the Scottish government after detective Shirley McKie was acquitted of perjury. Flawed fingerprint analysis was the only evidence against her. The report, published on 14 December, concludes that human error was to blame and voices serious concerns about how fingerprint analysts report matches. It recommends that they no longer report conclusions with 100 per cent certainty, and develop a process for analysing complex, partial or smudged prints involving at least three independent examiners who fully document their findings.

The recommendations lay bare fundamental problems which have demanded attention for decades, says Jim Fraser, a forensic scientist at the University of Strathclyde in Glasgow, UK. In interviews with 400 fingerprint experts from around the world, he found that 80 per cent believe fingerprint identifications are reliable. And although several recent cases have hinted that fingerprint analysis should be treated with caution, it remains a mainstay of forensic identification.

Following calls to address forensic methods by the US National Academy of Sciences in 2009, a team led by Itiel Dror of University College London has investigated the weaknesses in fingerprint examination. In one study, they looked at whether allowing examiners to see a suspect's print when analysing one taken from a crime scene - common practice in fingerprint labs - would influence their judgement.

They gave 20 analysts from different countries 10 crime-scene prints, five of which were accompanied by a suspect's prints, and asked them to count "minutiae", or distinguishing characteristics, in the crime-scene prints. Seeing a suspect's print usually reduced the number of minutiae found. Examiners also identified different minutiae. Another group, of 10 analysts, differed in their conclusions about 10 prints when shown the same set several months later (Forensic Science International, DOI: 10.1016/j.forsciint.2010.10.013). Dror likens it to a doctor giving two diagnoses - one benign, one fatal - for the same X-ray image.

In a separate study, he looked at how automated fingerprint identification systems (AFIS), which are commonly used to trawl print databases and provide a list of possible matches, could sway judgement. He gave 23 examiners a print and AFIS lists of possible matches - but in some of the lists the position of the actual match on the list was changed.

Examiners are meant to judge all AFIS-generated prints as possible matches, but Dror found they spent longer looking at prints at the top of the list. When the genuine match was lower down, they were more likely to dismiss it and identify a print at the top of the list as the correct match (Journal of Forensic Science, DOI: 10.1111/j.1556-4029.2011.02013.x).

"This is not a fatal blow to fingerprints, but it means we need to take countermeasures to minimise the effects of bias," says Dror. In addition to the recommendations of the Fingerprint Inquiry, he says examiners should always analyse crime-scene prints and document their findings before seeing a suspect's print, and should have no access to other contextual evidence.

Storm halts trains, cruise ships in Sweden, Norway (AP)

STOCKHOLM ? Authorities and local media say a storm sweeping across Norway and northern Sweden has disrupted train traffic and brought cruise ships on the famous Hurtigruten route to a standstill.

The Swedish Meteorological and Hydrological Institute issued a class 2 warning for northern Sweden on Sunday, its second highest level. As a result, Swedish traffic authorities have canceled all train traffic in the area between Sunday evening and Monday morning.

Norwegian news agency NTB reported the storm also has forced two ships on the scenic Hurtigruten route to a standstill in Trondheim. It said around 400 passengers were stranded in the town in central Norway.

America?s Credit Union moves to new location

America?s Credit Union has relocated its branch on Martin Way into a former First Citizens Bank branch in Lacey at 8308 Quinault Drive N.E., a spokeswoman for the credit union said Wednesday.

ACU bought the building from First Citizens and opened for business in its new location on Oct. 11, Heidi West said. ACU, a federally chartered credit union, which largely serves the military at Joint Base Lewis-McChord, also has plans to open two branches in Yelm next year, she said. The credit union is building a new branch that will open in February and a second branch inside the Walmart store will open in March, West said.

The former First Citizens Bank branch in Lacey is one of several branches in the region that First Citizens has decided it no longer needed.

First-Citizens Bank & Trust Co. of Raleigh, N.C., has operated in South Sound since Sept. 11, 2009, the day it acquired Venture Bank of Lacey, a failed bank that was closed by state regulators and sold to First Citizens in a deal brokered by the Federal Deposit Insurance Corporation.

First Citizens has scaled back its presence in the area ever since.

After Venture Bank closed, First Citizens occupied Venture?s DuPont headquarters for a few months before relocating staff members to its Lacey branch on College Street in March 2010.

It also closed former Venture Bank branches in Lakewood, Puyallup and Woodinville.

First Citizens Bank then announced it would close five South Sound bank branches, affecting locations in west Olympia, Lacey, downtown Tacoma, Kent and the Pioneer branch in Gig Harbor. ACU acquired the branch in Lacey and O Bee Credit Union is expected to open in the former First Citizens Bank branch at Harrison Avenue and Cooper Point Road next month.

China activist given 10 years' jail for subversion (AP)

BEIJING ? A Chinese court sentenced a veteran dissident who organized a pro-democracy activist network to 10 years' imprisonment Monday for inciting subversion, his wife said, the second heavy punishment for a dissident in recent days.

The stiff sentences come near the end of a year in which the Chinese government has used various means to silence dissent, from lengthy imprisonment to months of disappearances, in a crackdown aimed at preventing Arab Spring-style uprisings.

A court in the southern city of Guiyang found Chen Xi guilty of the charge of "incitement to subvert state power" for 36 essays he wrote and posted online, his wife said by phone.

Chen maintained his innocence but will not appeal the verdict, Zhang Qunxuan said.

"This is utterly absurd," Zhang said. "Chen Xi told the court it did not take into consideration the things he has written as a whole, and has interpreted his words out of context. But they have power and they don't listen."

"The court said he was a repeat offender and also that this is a very serious crime," she said. Chen was active in the 1989 Tiananmen Square pro-democracy protests and was sentenced to three years in prison, and several years after that, he was jailed for 10 years on charges of counterrevolutionary offenses, Zhang said.

His sentence comes three days after another veteran activist, Chen Wei, a dissident in the southwestern city of Suining, was sentenced to nine years' jail for the same offense.

The lengthy sentences against the two, who are not related, are in line with the Chinese government's long practice of punishing heavily veteran activists who have refused to give up despite decades of harassment. This appears to have worsened after anonymous online calls urged Chinese to imitate the uprisings of North Africa and the Middle East earlier this year.

"The fear factor ? the government's panic over sparks of the Arab uprising ? is no doubt driving the severe punishment of its critics," said Renee Xia, international director of Chinese Human Rights Defenders. "But suppression of views and expression will not address the root causes of social unrest."

Other recently jailed veteran dissidents include Liu Xianbin, a democracy activist who has previously spent a decade in prison and was given another 10 year sentence in March. On Christmas day in 2009, Liu Xiaobo was sentenced to 11 years in prison for co-authoring Charter 08, which called for an end to single-party rule and advocated democratic political reforms.

In Chen Xi's case, the subversion charge is also likely aimed at punishing and silencing him for his work with the Guizhou Human Rights Forum, a network of activists that organized human rights and pro-democracy activities in the southern Chinese region.

"The arrest and sentencing of dissidents is essentially motivated by a logic of information control, that the government wants to prevent the exposing of the real human rights situation on the ground," said Human Rights Watch Asia researcher Nicholas Bequelin. "Therefore people who report those kinds of news are generally the ones who get arrested."

Several of the members of the network have served prison sentences for related activities, according to the Chinese Human Rights Defenders.

Chen Xi was arrested Nov. 29 and charged in the southern province of Guizhou. Calls to the Guiyang Intermediate People's Court, where the trial was held, rang unanswered Monday.

The Chinese government has held these trials during the Christmas period to limit the criticism it receives for the heavy punishments being handed down, Bequelin said.

"It does work really well because there's no diplomatic activity around Christmas," he said. "By the time the diplomats get back to their desks, the sequence of events has moved on already. Therefore it does ensure the government receives less criticism for this."

(AP) ? The release of Nike's new Air Jordan basketball shoes caused a frenzy at stores across the nation Friday as scuffles broke out and police were brought in to stamp out unrest that nearly turned into riots in some places.

Shoppers stood in long lines through the night to get their hands on a retro version of one of the most popular models of Air Jordans ever made. The fights were reminiscent of violence that broke out in the early 1990s on streets across America as the shoes became popular targets for thieves.

In suburban Seattle, police used pepper spray on about 20 customers who started fighting at the Westfield Southcenter mall.

The crowd started gathering at four stores in the mall around midnight and had grown to more than 1,000 people by 4 a.m., when the stores opened, Tukwila Officer Mike Murphy said.

"Around 3 (a.m.) there started to be some fighting and pushing among the customers," he said. "Around 4, it started to get pretty unruly and officers sprayed pepper spray on a few people who were fighting, and that seemed to do the trick to break them up."

Murphy said no injuries were reported, although some people suffered cuts or scrapes from fights. An 18-year-old man was arrested for assault after authorities say he punched an officer.

"He did not get his shoes; he went to jail," Murphy said. Shoppers also broke two doors.

In Richmond, Calif., police say crowds waiting to buy the Air Jordan 11 Retro Concords at the Hilltop Mall were turned away after a gunshot rang out around 7 a.m.

No injuries were reported, but police said a 24-year-old suspect was taken into custody. The gun apparently went off inadvertently, the Contra Costa Times reported.

The frenzy over Air Jordans ? the new pair retails for about $180 ? has been dangerous in the past. Some people were mugged or even killed for early versions of the shoe, created by Nike Inc. in 1985.

The Air Jordan has since been a consistent hit with sneaker fans. A new edition was launched each year, and release dates had to be moved to the weekends at some points to keep kids from skipping school to get a pair.

No one anticipated the hysteria around the original Air Jordan, which spawned a subculture of collectors willing to wait hours to buy the latest pair. Some collectors save the shoes for special occasions or never take them out of the box.

But the uproar over the shoe had died down in recent years. These latest incidents seem to be part of trend of increasing acts of violence at retailers this holiday shopping season, such as the shopper who pepper-sprayed others at a Wal-Mart in Los Angeles on Black Friday and crowds looting a clothing store in New York.

A representative for Nike, based in Beaverton, Ore., was not immediately available for comment.

Other disturbances reported at stores across the country ranged from shoving and threats to property damage and attempted robbery.

In Taylor, Mich., about 100 people forced their way into a shopping center around 5:30 a.m., damaging decorations and overturning benches. Police say a 21-year-old man was arrested.

In Lithonia, Ga., at least four people were arrested after customers broke down a door at a store selling the shoes. DeKalb County police said up to 20 squad cars responded.

Officers escorted most of the people outside but took four into custody, Fox 5 Atlanta reported.

In Northern California, two men were arrested at a Fairfield mall after crowds shoved each other to get in position for the Nikes, police said.

In Stockton, Detective Joe Silva said a person was taken into custody at Weberstown Mall on suspicion of making criminal threats involving the shoes. Police also were investigating an attempted robbery in the mall's parking lot. The victim was wrongly believed to have just purchased Air Jordans.

Police also were called to malls in Nebraska, Ohio and Kentucky over reports of large crowds, fights and broken doors.

In Tukwila, Officer Murphy said the crowd was on the verge of a riot and would have gotten even more out of hand if the police hadn't intervened.

About 25 officers from Tukwila and surrounding areas responded. Murphy said police smelled marijuana and found alcohol containers at the scene.

"It was not a nice, orderly group of shoppers," Murphy said. "There were a lot of hostile and disorderly people."

The Southcenter mall's stores sold out of the Air Jordans, and all but about 50 people got a pair, Murphy said.

Shoppers described the scene as chaotic and at times dangerous.

Carlisa Williams said she joined the crowd at the Southcenter for the experience and ended up buying two pairs of shoes, one for her and one for her brother. But she said she'll never do anything like it again.

"I don't understand why they're so important to people," Williams told KING-TV. "They're just shoes at the end of the day. It's not worth risking your life over."

How China and America Can Work Together to Solve Climate Crisis | Truthout

Announcing:?Debt-for-Nature Coalition for US and China (DNCUSC, or DNC)

So you thought, "we're screwed. The UN Climate Change Conference talks in Durban were a pre-ordained failure, and no progress is possible for who knows how long."

Fortunately, there is a way to immediately begin bypassing nationalistic and corporate power-tripping in Durban and at the UN. It relies on a win-win-win grassroots, bottom-up resolution, starting at the local level.

In this package, U.S. residents are incentivized to cut individual greenhouse gas emissions -- say, by taking up bicycling to replace driving. Such energy-quantifiable steps are taken in order to?reduce the debt owned by China. Here's why this makes sense to a broke, little-respected, over-extended U.S. government, and to the emerging giant China, in the post-cheap oil world:

China would write off a large amount of U.S. indebtedness, as done in the practice called debt-for-nature swap. Thus, China-- the world's top emitter -- would be able to claim carbon-emissions reduction credit it will soon want. Carbon reduction by China and all other nation-signatories will be required in the post-Kyoto Protocol global agreement. China has low per-capita greenhouse gas pollution, and thus feels that the U.S. -- as long-time number-one emitter -- needs to lower its high per-capita emissions.

With the U.S. enjoying debt reduction, China enjoying carbon credits, and Americans rewarded through incentives to cut energy consumption and sequester carbon, everyone wins. All other nations win too, as this debt-for-nature proposal, if successful, could break the climate talks' deadlock and resuscitate the Kyoto process. Additionally, the increasingly belligerent tone between the U.S. and China -- perhaps relating to strategic oil in the Pacific ocean, after the U.S. had less than spectacular success for petroleum in Iraq and Afghanistan -- would soften, thanks to a new treaty between the climate-altering titans.

For making it worthwhile for the U.S. to meet the goal of energy conservation to achieve a much lower carbon footprint while cutting back foreign oil addiction, China not only gets Kyoto-style credit but can work toward its additional strategic reductions for a more resilient economy. For example, the country could be better positioned to install more renewable energy systems. It is already the top solar panel maker in the world. It would be tragic if China chose to do the minimum to qualify for its carbon reduction efforts on the backs of hard working Americans. So China should be required to honor the Kyoto spirit by slashing fossil fuels combustion, while pursuing renewable energy and efficiency -- even though the country will have gained, for little effort, vast carbon credits from its U.S. deal.

An attraction to this debt-for-nature swap is the immediate relief on our besieged atmosphere: 2010 was an alarming example of maximizing emissions, so 2011 was unsurprisingly one of hottest years in history. An ice shelf's near total melting in northern Canada was a shocker. Our problems are just beginning, and climate scientists confirm this by starting to give up on the possibility of seeing temperature-rise get under control this century.

Lifestyle change involving energy curtailment is the fastest way to slash carbon emissions. Maximizing renewable energy systems in the future is worthwhile to work toward now, but to put all effort toward a technological fix, without slashing emissions now, loses precious time as the planet heats up. We don't want to be guilty of "too little, too late."

Individuals can publicly resolve to do their part now to begin (or further) their emission reduction, and urge others to do so via the city-council resolution process. The resolution is a mechanism that would also call for state and national adoption of the goal of emissions reduction via the debt-for-nature swap, through bike-riding, growing food more locally, sail-transport of freight and passengers, etc. Individuals can be tempted through incentives, such as getting relief on student loans, qualifying for more food stamps, enjoying local discounts by "participating patriotic businesses" that support the resolution, etc.

In addition to the local resolutions and grassroots movement to slash per-capita emissions, the state and federal governments can join in the carbon-reduction effort in any way that works. The government would reorient policy toward debt reduction via energy conservation -- with a bonus of better national physical fitness for lower health-care costs, by driving less and gardening more -- stemming from low-polluting behavioral change. Let us imagine also the improved financial health for the U.S. economy, with a stronger social safety net, thanks to China's exercising its real need for global emissions target-reduction through obtaining carbon credit.

Ways that the U.S. would enact more energy-efficient policies are on all levels, including cargo shipping, jet travel, building insulation, and agriculture. Specific programs would include depaving of parking lots and driveways, reducing product-packaging, and re-forestation and other carbon sequestration. U.S. citizens would also be rewarded for having fewer offspring by losing tax breaks for bearing more dependents. The birth rate in the U.S. is comparably very high for an industrialized country, so why encourage creating more consumers of the least energy-efficient population on Earth?

The concept for a U.S.-China debt-for-nature swap entered the White House's Council on Environmental Quality, during the debt-ceiling crisis of last July. At the same time, China's reporting on the same crisis included the debt-for-nature concept, mentioning sail power as one of the tools to reduce carbon emissions [by reducing horrendous bunker fuel use]. For Culture Change to propose a Debt-for-Nature Coalition for US and China (DNCUSC, or DNC), when we are just a small organization (although frequent participant in UN climate meetings), was not our preferred intention for moving the concept forward. But our behind-the-scenes networking in Washington, D.C., and encouraging activists and nonprofit groups to take the project on, has not yet resulted in fast promotion of the idea through the climate change protection community. It's a very nice netbook. It's cute, super portable, and has a nice battery life. My only problem with it is the OS that comes on it. Windows 7 starter is stripped down a lot. If you are a getting this strictly for business and don't plan on customizing it at all then it will be great for you. However if you are getting this as a personal computer, then splurge and get the better version of windows too. 12/08/2011

Pretty cool little netbook Bought this for my 9 year old Grand Daughter for a gift so she can Skype with her Dad who just returned from Pakistan. Have no experience with Laptops or Net books. Just arrived yesterday. Took it out of the box & set it up today. Connected by WiFi easily even though I have a very old 2 wire portal. Has 2 operating systems but I'm not very familiar with the cloud so I mostly used Windows 7. Skype downloaded & operated perfectly. There were really no updates to install. Product registration was easy enough. Had no Problems with it. Already put the backup on the flash drive from the bundle. Web cam could be better but I've seen worse. Will need to add speakers or a pair of headphones as the speakers are weak. Overall for the price I think it's a bargain. Might get one for myself. Also bought the 2 year crash, bash, spill & cracked screen policy from Walmart. Hope I don't have to use it. Put it all back in the box and am wrapping it up for Christmas. 12/10/2011

simple windows 7 starter is worthless.. id definely plan on an upgrade unless u seriously dont mind "just the basics" besides that its a great computer for a great value. also its very cute 12/19/2011
